Over the past decade, as both the Ohio courts and legislature increasingly made title defects fixable, forgivable, or meaningless,[1] the old fashioned title search has gained increasing importance. Why? Because when there are fewer ways to attack prior liens, one of the few weapons remaining is to not to have unknown prior liens in the first place. And this includes paying closer attention to the details held within the documents found in that search. This last one is the focus here.
